DECREE OF THE MINISTER OF AGRICULTURE

CONCERNING
TYPES OF DISTURBING ORGANISM OF QUARANTINE PLANT
GROUP I OF CATEGORIES A1 AND A2,
GROUP II OF CATEGORIES A1 AND A2, HOST PLANT, CARRIER MEDIA AND ITS DISTRIBUTION AREA.

WITH THE MERCY OF GOD THE ALMIGHTY
THE MINISTER OF AGRICULTURE,

Considering:

• a. that that with the Decree of the Minister of Agriculture No. 627/Kpts/PD.540/12/03 juntco Decree of the Minister of Agriculture No. 117/Kpts/PD.540/2/04 Types of Disturbing Organism of Quarantine Plant Group I, Group II and Its Carrier Media;
• b. that, with the developing science and technology, some types of disturbing organism of quarantine plants are not covered by the aforesaid Decree of the Minister of Agriculture likewise wit its distribution area, so that resulting in impediment in its implementation;
• c. that, based on the aforesaid consideration and in order to facilitate its implementation in the field, it is considered necessary to review the Decree of the Minister of Agriculture No. 627/Kpts/PD.540/12/03 and Decree of the Minister of Agriculture No. 117/Kpts/PD.540/2/04.

In view of:

• 1. Law No. 16/1992 on Animal, Fish and Plant Quarantine (Statute Book of 1992 No. 56, Supplement to Statute Book No. 3482);
• 2. Government Regulation No. 14/2002 on Plant Quarantine (Statute Book of 2002 No. 35, Supplement to Statute Book No. 4196);
• 3. Presidential Decree No. 187/M/2004 on Establishment of United Indonesian Cabinet;
• 4. Presidential Regulation No. 9/2005 joint Presidential Regulation No. 62/2005 on Status, Duties, Function, Authorities, Organizational Structure and Work System of Ministries of the Republic of Indonesia;
• 5. Presidential Regulation No. 10/2005 on Organizational Unit and Duties of Echelon I of the Ministries of the Republic of Indonesia;
• 6. Decree of the Minister of Agriculture No. 38/Kpts/HK.310/1990 on Requirements and Actions of Plant Quarantine For the Entry of Plant and Seedling Into the Territory of the Republic of Indonesia;
• 7. Regulation of the Minister of Agriculture No. 299/Kpts/OT.140/7/2005 on Organizational Structure and Work System of the Ministry of Agriculture joint Regulation of the Minister of Agriculture No. 341/Kpts/OT.140/9/2005 on Organizational Elements and Work System of the Ministry of Agriculture;

HAS DECIDED:

To stipulate:

DECREE OF THE MINISTER OF AGRICULTURE ON TYPES OF DISTURBING ORGANISM OF QUARANTINE PLANT GROUP of I CATEGORIES A1 AND A2, GROUP II OF CATEGORIES A1 AND A2, HOST PLANTS, ITS CARRIER MEDIA AND DISTRIBUTION AREA.

FIRST:

Types of Disturbing Organism of Quarantine Plant Group I of Categories A1 and A2, Group II of Categories A1 and A2, Host Plants, Its Carrier Media and Distribution Area are as specified in Attachment to this Decree.

SECOND:

1. Categories A1 as meant in the First dictum of this Decree namely types of disturbing organism of quarantine plants that are not existent in the Indonesian Territory.

2. Categories A2 as meant in First dictum of this Decree namely types of disturbing organism of quarantine plants that are existent in the Indonesian Territory.

THIRD:

For stipulation of change of types of disturbing organism of quarantine plants group I of categories A1 and A2, group II of categories A1 and A2, host plants, its carrier media and distribution area as meant in the First dictum, shall be conducted first by the Head of Agricultural Quarantine Agency.

FOURTH:

Upon enactment of this Decree, the Decree of the Minister of Agriculture No. 627/Kpts/PD.540/12/2003 on Types of Disturbing Organism of Quarantine Plant Group I, Group II, and its Carrier Media and the Decree of the Minister of Agriculture No. 117/Kpts/PD.540/2/2004 on Revocation of THIRD Dictum OF THE Decree of the Minister of Agriculture No. 627/Kpts/PD540/12/2003, is declared as null and void.

FIFTH:

This Decree comes to force as of the date of stipulation.
